1. Acceptance and Definitions

These Terms and Conditions (the “Agreement”) govern your access to and use of our digital products and services. This Agreement is between you (the “User” or “you”) and Al-Injazat Technologies (مؤسسة الإنجازات لتقنية المعلومات), Khobar, Kingdom of Saudi Arabia (“we”, “us”, or the “Developer”).This Agreement applies to all of our current and future digital products, services, applications, and websites that we develop, publish, or operate, referred to as the “Services”.By creating an account or using the Services, you acknowledge that you have read this Agreement and agree to be bound by it and by the accompanying Privacy Policy. If you do not agree, you may not use the Services.

2. Provider Identity and Scope

We develop and operate our Services in our capacity as the Developer and provider. This Agreement applies in its unified form to every current and future Service of ours, unless additional specific terms are defined for a particular Service, in which case those specific terms are read together with this Agreement and prevail in case of conflict within the scope of that Service.

3. Eligibility

You must be at least 18 years old and have full legal capacity to enter into this Agreement. If you use the Services on behalf of an entity, you represent that you are authorized to bind it to this Agreement.

4. Accounts and Registration

Using some features may require creating an account via your mobile number and verifying it with a code sent to you (SMS). You are responsible for the accuracy of your information, for keeping your account access confidential, and for all activity that occurs through it. Notify us immediately of any unauthorized use. We may suspend or terminate an account upon breach of this Agreement or the law.

5. Licence to Use

We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Services for your personal, non-commercial purposes, in accordance with this Agreement. This licence transfers to you no ownership rights in the Services, their code, or their marks.

6. Acceptable Use

You agree not to: (a) use the Services for any unlawful or prohibited purpose; (b) attempt unauthorized access to systems or breach their security; (c) reverse engineer, copy, modify, or create derivative works from the Services except as permitted by law; (d) overload or misuse resources or distribute malicious software; (e) infringe the intellectual property or privacy rights of others; or (f) use the Services in violation of the applicable laws of the Kingdom of Saudi Arabia or public morals.

7. Intellectual Property

All rights in the Services – including the code, designs, interfaces, content, trademarks, and our product names – are owned by or licensed to the Developer and protected under intellectual property laws. They may not be used without our prior written permission.

8. Third-Party Content and Services

Some tools rely on data or services from third parties (such as map, weather, national-address data, and stores). We do not warrant the accuracy or availability of such data and are not responsible for third-party content or policies.

9. Subscriptions and Payments

We may offer paid features via in-app subscriptions:

  • Purchases and subscriptions are processed through the app store (Apple App Store / Google Play) and the subscription-management provider, and are also subject to that store’s terms.
  • Auto-renewal: subscriptions renew automatically for a similar period unless you cancel renewal before the end of the current cycle via your store account settings.
  • Prices and taxes: prices are shown inclusive of applicable taxes (such as VAT) where applicable, and we may adjust them in the future with prior notice.
  • Refunds: refund requests are subject to the relevant store’s policy and the applicable laws of the Kingdom of Saudi Arabia (including the E-Commerce Law where applicable).
  • Cancelling a subscription stops future renewal and does not necessarily entitle you to a refund for the remaining period, unless the law or store policy provides otherwise.

10. Changes to the Services

We continuously develop our Services and may add, modify, or discontinue features in whole or in part at any time. Experimental features may be offered “as is” without warranty. We aim to notify you of material changes where possible.

11. Disclaimers and Nature of the Tools

The Services are provided “as is” and “as available” without any express or implied warranty. In particular:

  • Tool results (such as prayer times, qibla direction, astronomical and magnetic calculations, distance/height/noise/vibration measurements, and location) are estimates for guidance and informational purposes only, and may be affected by the accuracy of your device sensors, third-party data, and usage conditions.
  • The Services must not be relied upon in critical, safety-related, or emergency situations (such as critical navigation, earthquake warning, or professional engineering, medical, or navigation decisions). Consult official sources and specialists when needed.
  • We do not warrant that the Services will be uninterrupted or error-free, or that they will meet all your expectations.

12. Limitation of Liability

To the extent permitted by applicable law, neither we nor our personnel or providers are liable for any indirect, consequential, incidental, or special damages, or for loss of data, profits, or opportunities, arising from your use of or inability to use the Services. In all cases, our total liability shall not exceed the amounts you paid us (if any) in the twelve months preceding the event giving rise to the claim. This clause is not intended to exclude any liability that may not lawfully be excluded.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or expenses (including reasonable legal fees) arising from your breach of this Agreement, the law, or the rights of others.

14. Privacy

The processing of your personal data is governed by our Privacy Policy, which forms an integral part of this Agreement. Please review it for details on data collection, use, and your rights.

15. Termination

You may stop using the Services and delete your account at any time. We may suspend or terminate your access upon your breach of this Agreement or the law, or for operational or security reasons. Provisions that by their nature should survive (such as intellectual property, limitation of liability, and governing law) remain in effect after termination.

16. Force Majeure

We are not liable for any breach or delay resulting from causes beyond our reasonable control, including network or cloud-service outages or emergency events.

17. Governing Law and Jurisdiction

This Agreement is governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. The competent judicial authorities in the Kingdom of Saudi Arabia have jurisdiction over any dispute arising from or relating to it. However, this choice does not deprive you of any mandatory protection afforded to you by the consumer-protection law of your home jurisdiction, where such law is mandatorily applicable.

18. General Provisions

  • Severability: if any provision is held invalid or unenforceable, the remaining provisions remain in effect.
  • No waiver: our failure to exercise a right is not a waiver of it.
  • Assignment: you may not assign your rights under this Agreement without our written consent; we may do so as part of a business transfer.
  • Entire agreement: this Agreement together with the Privacy Policy constitutes the entire agreement between us regarding the Services.
